Possible Tax Benefits

It is possible that a donation of a conservation easement could create three or more tax benefits for you or your heirs.

An easement on your ground could result in a lesser value for the property if it is transferred to someone as an estate inheritance.  The lesser estate tax being paid by the heir could make it easier to hold the property versus having to sell to pay the estate tax. After an easement is recorded it is wise to ask the county assessor to review your assessed value. Your real estate taxes should be lowered.

The appraisal you have done on your property should reflect the value of the easement donation.  That donation to our 501C3 organization should qualify you for tax deductions on your state or federal income tax.  The value of the donation can be used over six years to deduct up to 30% of your gross income.  Please contact your legal council and tax experts to review current laws and your person tax situation.
